Pocket Change Closed Alpha Tester Agreement

This agreement is between you and Feral Bandit Studios (“we”, “us”, “our”), contact [email protected]. It covers your place in the closed alpha test of our game Pocket Change. Please read all of it. By ticking the box and requesting an invite, you agree to be bound by it. If you don’t agree, please don’t sign up.
1. Definitions
“The Game” means Pocket Change in any pre-release form, including every build, update, installer, file, asset, code, save file, artwork, music, sound, text, story, character, feature and design. “Confidential Information” means the Game and anything we share with you about it or about our studio that has not been made public by us, including access codes, download links, emails, Discord messages, plans, release dates, prices and feedback discussions. “Test” means the closed alpha test of the Game.
2. Who can take part
You must be 18 or over and give us your real name and an email address that belongs to you. Places are limited. We decide who takes part, and we can accept or turn down any request, or end anyone’s place at any time, without giving a reason.
3. Your licence to play
If we approve you, we give you a personal, limited, non-exclusive, non-transferable, revocable licence to download, install and play the Game on computers you own or control, only for the purpose of testing it and giving us feedback, and only while the Test runs and your access is active. Your access code works on a limited number of computers. Nothing else is licensed to you. When the Test ends, when your access ends, or when we ask, you must stop playing and delete every copy of the Game you have.
4. Keep it confidential
Everything about the Game and the Test is Confidential Information. You must keep it secret and must not share it with anyone in any form. In particular, you must not:
- take, post, send or share screenshots, photos (including photos of your screen taken with a phone or camera), videos, recordings, clips, GIFs, streams or audio of the Game;
- livestream or broadcast the Game, or let anyone else watch you play, in person or online;
- describe, review, rate, discuss or give your impressions of the Game, its story, characters, features, bugs or content to anyone;
- post anything about the Game or the Test on any social media or website, including TikTok, Instagram, X (Twitter), Facebook, YouTube, Twitch, Reddit, Threads, Bluesky, Steam, forums, blogs, wikis, review sites, or any Discord server other than our official one;
- share anything about the Game in private messages, group chats or emails with anyone, including friends and family;
- say publicly that you are a tester, unless we have said that you may.
The only places you may talk about the Game are the feedback tool inside the Game, email to us, and the tester channels of our official Discord server. Anything you post there stays confidential and must not be copied elsewhere.
These duties start now and carry on after the Test ends. They end only for information that we ourselves make public (and only to the extent we made it public), or when we release you from them in writing. If the law requires you to disclose something, you may do so only to the extent required, and you must tell us first if the law allows.
5. No copying, sharing or redistribution
You must not copy (except to install it as allowed above), share, send, upload, sell, rent, lend, give away, trade, distribute, publish, torrent or otherwise make available the Game, its installer or any of its files, by any means, to anyone. Your access code and download links are for you alone: you must not share them, post them or let anyone else use them. If you think your code or a copy of the Game has got out, tell us straight away. We may mark builds so that leaks can be traced to the tester they came from.
6. No tampering
You must not reverse engineer, decompile, disassemble, data-mine, unpack, modify, patch or extract assets, code or data from the Game, make tools, mods or cheats for it, or try to get round its access check or any other protection, except to the extent the law expressly allows despite this agreement.
7. Feedback
Your feedback, bug reports, ideas and suggestions (“Feedback”) help us. You agree that we may use, change, publish and make money from Feedback in any way, for free, forever, without crediting or paying you, and you give us all the rights needed to do so. To the extent the law allows, you waive any moral rights in Feedback. Please don’t send us anything you don’t have the right to give us.
8. Your data
To run the Test we keep your name, email address, access code and the date and details of your agreement to these terms (including the version and the IP address you signed up from). Each time the Game starts it checks your code with our website and sends your code, a computer identifier and the build number. If you choose to send feedback or crash reports, they may include screenshots, your save file, your system details and logs. We use this only to run the Test and improve the Game, and we never sell it. See our privacy policy. You can ask us to delete your data at any time by emailing us, which also ends your place in the Test.
9. Unfinished software: use at your own risk
The Game is unfinished. It is provided “as is”, may contain bugs and errors, may crash, may lose your progress, and may change or stop working at any time. Back up anything important before installing it. To the fullest extent the law allows, we give no promises or warranties about the Game and we are not responsible for any loss or damage arising from the Test or the Game, including loss of data, and our total liability to you is limited to fifty pounds (£50). Nothing in this agreement limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
10. No payment, no other relationship
Taking part is voluntary and unpaid. It does not make you our employee, worker, contractor, partner or agent, and it does not give you any right to a copy of the finished Game, a credit, or a place in future tests.
11. Ownership
We (and our licensors) own the Game and all rights in it. You get only the limited licence in section 3.
12. Breaking this agreement
If you break this agreement, we may end your access immediately and without warning, and you must delete every copy of the Game at once. Breaking sections 4, 5 or 6 could cause us serious harm that money alone cannot put right, so we may ask a court for an injunction to stop it, as well as claiming damages and any other remedy available, including our reasonable legal costs. You will be responsible for losses we suffer because you broke this agreement.
13. Ending
You can leave the Test at any time by emailing us and deleting the Game. We can end the Test, or your place in it, at any time. Sections 4 to 9, 11, 12 and 14 continue after the Test or your place in it ends.
14. General
We may update this agreement. If we do, we’ll email you and you must accept the new version to keep taking part. We keep a record of which version you agreed to and when. This agreement is the whole agreement between us about the Test. If any part is found to be unenforceable, the rest still applies. If we don’t enforce a term straight away, we can still enforce it later. You may not transfer this agreement to anyone else. This agreement is governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, although if you live in Scotland or Northern Ireland you may also bring proceedings there.
